In any case, JOTRIN Neither shall be liable to Buyer or any third party for any indirect, incidental, special, consequential, punitive or exemplary damages (including, without limitation, lost profits, lost savings or lost business opportunities) arising out of or in connection with the Purchaser. The foregoing remedies shall be subject to written notice of defect by Buyer within sixty (60) days of purchase and return of the defective product. The foregoing remedies do not apply to products that have been subject to misuse (including, but not limited to, electrostatic discharge), neglect, accident, or modification, or to products that have been welded or altered during assembly, or to products that cannot be tested.
